Free Speech Coalition v. Paxton: A Modern First Amendment Paradigm Shift

Abstract
On January 15, 2025, the Supreme Court heard the oral arguments for Free Speech Coalition v. Paxton. The case is highly polarizing and centers around Texas law H.B. 1181, which seeks to impose age verification requirements for commercial entities that provide access to pornographic media. H.B. 1181 is just one manifestation of a larger trend of conservative–leaning states imposing legislation to restrict citizens’ access to online pornographic content. These bills have been met with considerable controversy over concerns that they confer material violations of fundamental First Amendment rights. This article will examine the case’s procedural history as well as similar antecedent cases. I will conclude by discussing the potential for a paradigmatic shift in modern First Amendment jurisprudence, in addition to providing commentary regarding the possible implications of this case’s conclusion.
